FDA Allows Sales of "Heat-Not-Burn" Tobacco Device

In a news release, the agency said that "authorizing these products for the U.S. market is appropriate for the protection of the public health because, among several key considerations, the products produce fewer or lower levels of some toxins than combustible cigarettes." The agency added: "It does not mean these products are safe or 'FDA approved.' All tobacco products are potentially harmful and addictive and those who do not use tobacco products should continue not to."

The IQOS system meets the federal definition of a cigarette and therefore must follow FDA regulations on cigarettes. In particular, the agency said it will "make certain that the company complies with ... marketing restrictions to prevent youth access and exposure." In a news release, the president of the Campaign for Tobacco-Free Kids cautioned that if such restrictions aren't enforced, "there is a serious risk that IQOS will become the next Juul and worsen the current youth epidemic."

Dr. Rich Saitz, an addiction medicine specialist with Physician's First Watch, notes that in the age of e-cigarettes, distributing a tobacco device that is very likely more dangerous doesn't seem to have any role in protecting the health of the public.
